1. Introduction and Acceptance
Welcome to Envorum (hereinafter referred to as the "Protocol", "We", or "Platform").
By using our website, mobile application, or smart contracts, you (hereinafter referred to as the "User") agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you must immediately cease using the Service.
1.1. Jurisdiction and Arbitration Relationships are governed by the laws of the Republic of Singapore. Any disputes arising out of or in connection with this Agreement shall be finally settled in accordance with the Arbitration Rules of the Singapore International Arbitration Centre (SIAC).
1.2. Age Restrictions The Service is intended for individuals aged 18 years or older. Individuals aged 13 to 18 may participate in environmental events only under the direct supervision of parents or legal guardians, who assume full responsibility for their safety.
2. Nature of Service
Envorum is a technology platform connecting Organizers, Volunteers, and Donors.
Information Intermediary: We provide coordination tools (Map, Chat, Wallet), but we are not the organizer of events conducted by users. We do not control the actions of participants offline.
No Employment Relationship: Volunteers and Scouts act voluntarily and independently. Envorum is not your employer. Performing tasks (Research Tasks) or participating in cleanups does not create an employment, agency, or partnership relationship between you and the Platform.
3. Disclaimer and Assumption of RiskCRITICAL SECTION. PLEASE READ CAREFULLY.
Participation in environmental actions (In Real Life) involves physical activity in outdoor settings. By using the Service, you acknowledge and agree that:
Personal Risk: You participate in events at your own risk. Risks may include (but are not limited to): difficult terrain, adverse weather conditions, contact with wild animals/insects, and risk of injury from hazardous waste (glass, metal, chemicals).
Release of Liability: Envorum, its founders, employees, and investors bear no responsibility for any injury, health damage, loss of personal property, or death occurring during participation in events organized through the Platform.
Waiver of Claims: You voluntarily waive the right to file lawsuits against Envorum regarding incidents occurring during fieldwork.
4. Account and Security
Verification (KYC): To access financial functions (withdrawals, fundraising, large transfers), you are required to complete identity verification via our partner (Sumsub). Providing fake documents will result in a permanent ban without the right to reinstatement.
Access Security: You are fully responsible for the security of your credentials. The Protocol does not have access to your passwords or private keys (in the case of Web3 wallet usage) and cannot recover access to funds if they are lost.
Non-Transferability: Selling, renting, or transferring a verified account to third parties is strictly prohibited.
5. Financial Terms
Unit of Account: Internal settlements are conducted in ENVO units (1 ENVO ≈ 1 USD). This is a record of obligation (Utility/Reward point), not an investment token or security.
Platform Fees:
Deposit Fee: The Platform charges a fixed 5% commission upon balance top-up (fiat or crypto asset deposit). This fee supports the protocol's operational activities.
Internal Fee: Internal transfers, event donations, and reward payouts to participants are executed commission-free (0%).
Taxes: You are solely responsible for declaring income and paying taxes in your jurisdiction. Envorum does not act as a tax agent for the user.
Refund Policy:
If an event is Canceled (did not take place or failed moderation), reserved funds are returned to the Donors' internal balance in full.
If an event is Completed and Verified (Verified status), donations are considered used for their intended purpose and are non-refundable.
6. Code of Conduct
It is prohibited to use the Platform for:
Fakes and Manipulation: Uploading others' photos, generating reports via AI, using photo editors to simulate cleaning, or colluding to farm rewards.
Political Activity: Organizing political rallies, protests, campaigning, or acts of civil disobedience under the guise of environmental events.
Violation of Laws and Boundaries: Organizing events on private property without permission (Trespassing) or in restricted/dangerous zones.
Fraud: Fundraising for fictitious purposes unrelated to ecology or social good.
Sanctions: Violation of these rules leads to immediate account blocking, freezing of funds on the internal balance, and entry into the global blacklist.
7. Intellectual Property
User Content: By uploading photo reports (Before/After) to the Platform, you grant Envorum a non-exclusive, worldwide, perpetual, royalty-free license to use these materials (display on the map, use in marketing materials, training AI models to improve trash detection).
NFTs and Achievements: Digital certificates of participation (Impact NFTs) belong to users, but the Platform retains the technical right to revoke (burn) NFTs if it is proven post-factum that they were obtained fraudulently.
8. Force Majeure
Envorum is not liable for failure to perform obligations caused by circumstances beyond reasonable control, including: blockchain network failures (Base, Ethereum), internet outages, wars, pandemics, natural disasters, or changes in legislation rendering the Protocol's operation impossible.
